Terms and Conditions for using BURQ FX

IT IS IMPORTANT FOR YOU TO READ AND UNDERSTAND OUR TERMS AND CONDITIONS BEFORE YOU ACCEPT THEM. THEY CONTAIN LIMITATIONS ON THE SCOPE OF OUR OBLIGATIONS TO YOU, AS WELL AS LIMITATIONS AND EXEMPTIONS FROM OUR LIABILITY TO YOU FOR DAMAGE THAT YOU MAY SUFFER AS THE RESULT OF USING BURQ FX FINANCIAL SERVICES.

Our Terms and Conditions use the following definitions:

  • "BURQ FX", "We", "Our" or "Us" refers to BURQ FX and also includes BURQ FX's affiliates or agents insofar as these assume operations which otherwise would have to be performed by BURQ FX in order to provide the Service.
  • "BURQ FX Website" or "Website" refers to the website which We operate in order to provide online money transfer services; and
  • "You", "Yours" or "Your" refers to every person and any person using the BURQ FX Website as a Sender.
  • "Payment Method" refers to the options available to the Sender to fund a money transfer through BURQ FX, which may vary from country to country and may include Bank Cards, bank accounts and other payment methods.
  • "Prohibited Purpose" refers to any unlawful purpose; including but not limited to, making or receiving payments for gambling services, gambling chips or gambling credits; or sending a payment to yourself as the Receiver in order to evidence financial soundness (RISK OF FRAUD); or sending or receiving money on behalf of someone else.
  • "Receiver" refers to the person named as the beneficiary of the money transfer;
  • "Sender" refers to the person who initiated a money transfer through BURQ FX;
  • "Transaction" refers to every money transfer that You initiate through the BURQ FX;

About Us

The registered office of BURQ FX, a company that provides payment services, is located at One Canada Square, 37th Floor, Canary Wharf, London, United Kingdom, E14 5AA. Under FCA FRN No. 508565, BURQ FX is permitted to offer payment services by the FCA.

International money transfer services are provided by BURQ FX. BURQ FX delivers the service online through our mobile app/online web portal.

Contract

Every financial transaction between BURQ FX and the sender of the funds results in a unique agreement.

When you send money through BURQ FX, you consent to our employing our partners to handle your transaction and to sharing pertinent information with them. The full agreement/contract between BURQ FX/its partners and you, which regulates the use of the service and the specific recipient of the service, is set forth in these terms and conditions and other related documentation.

Depending on changes in the law or regulatory requirements, terms and conditions may change. Any modifications made after a transaction has been completed will not be applicable to the current transaction. Only transactions completed after the amendments' effective date will be subject to them.

Our Services

The service allows you to send money to a recipient designated by you. The money can be collected by a recipient in cash or sent to the recipient's bank account or the customer can send money directly via Mobile App/ Web portal.

To use the BURQ FX service, you must be at least 18 years of age. The service is for personal use only and may not be used for gambling purposes, escrow, or trust purposes. Please read the fraud warning on the form. We will not be liable if you change your mind after a recipient designated by you has been paid.

When the money transfer is conducted, certain information will be requested including identification details which is a requirement to meet our regulatory responsibilities. Certain partners will require the selection of a pay-out agent in the receiving country. To change a payout location, you may need to contact our partner directly or we may need to refer your query to our partners.

A control number/PIN is provided to you on the completion of a transaction which must only be provided to the recipient of the transaction to enable the collection of the funds. BURQ FX provides various options for funds being received. The transaction can either be sent directly to a bank account or paid out in cash. For pay-outs in cash, on the receiving side, the recipient will also be requested to provide identification details to ensure that the correct recipient is being paid out.

BURQ FX will endeavor to make the transaction available for payment to the recipient either in a few minutes, by the end of the next working day or latest by the seventh business day depending on which partner the funds are sent through, subject to statutory or regulatory requirements. If a transaction has been processed at an agent location, a delay can occur if the agent location is unable to provide the funds for payment promptly.

The sender is responsible for providing the recipient with the details of the transactions to enable the collection of funds. Any errors in the details provided for the recipient could result in a delay in the transaction being paid. The fee for the transaction will be indicated on the receipt provided at the agent location or on the mobile app/online web portal.

Payment shall be made when the relevant details required by BURQ FX or its partners are provided by the recipient including the name of the sender, transaction number, amount sent and country from where the money was sent along with a valid government-issued ID, there may be some local restrictions and additional local regulatory requirements. The acceptable forms of identification differ depending on the country in which the transfer is collected. Payment shall be made to the person that BURQ FX or its agent deems entitled to receive the transaction pay-out.

BURQ FX will have fulfilled its requirement to you to pay out the transaction to the recipients providing the above-mentioned details. For pay-outs at agent locations, the pay-out will be made during the agent opening hours and if the agent has the funds available to conduct the pay-out.

Applicable laws prohibit money transmission companies from conducting business with certain individuals. BURQ FX and its partners are required to screen all transactions against the list of asset freeze targets issued by the office of financial sanctions implementation, HM treasury. If there is a match, BURQ FX will investigate to determine if the match is a real match to the name in the list, during the investigation, there may be a delay in the transaction being paid out. Additional details may be requested during the investigation, including additional identification details from the sender and/or recipient of the money transfer.

Fraud Warning

Send funds only to individuals you know or can verify as trustworthy. The service must only be used to send funds to family or friends and not for business purposes. if you suspect you are a victim of fraud, contact BURQ FX immediately on 020 8175 2519

Terms of Use of Website

Welcome to BURQ FX's website, also known as "the website" throughout the following. Before using the website and the information offered by BURQ FX, its subsidiaries, and affiliates (hereafter, "BURQ FX"), please read these terms and conditions of use (hereinafter referred to as "Terms"). You accept these Terms, which are a binding contract between you and BURQ FX., by accessing or using the website.

Do not access or use the website if you disagree with any of these terms.

BURQ FX has the right to change these Terms and any other material on this website at any time without providing you with prior notice. The most recent Terms will always be available on our websites, so please read them carefully before using the website. These conditions shall continue in full force and effect to the extent that they do not conflict with any medium-specific conditions of use that BURQ FX may post in addition.

You agree that you will only use the website in a way that complies with all applicable laws and regulations and only for legal purposes. Any content or information that you submit, post, or transmit through the website is strictly your responsibility. You consent to refrain from any actions that might damage, disrupt, or impair the website, such as planting malware, viruses, or other harmful code. In addition, you promise not to make unauthorised attempts to access the website or any associated accounts, systems, or networks.

You access and use third-party websites at your own risk; before using any such website, you should understand its applicable terms and policies.

Intellectual Property Rights

The BURQ FX Websites, including all previous, present, and future iterations; all pages contained within the BURQ FX Websites; the content and information on the BURQ FX Websites; all graphics, text, images, audio, videos, webinars, designs, compilations, advertising copy, articles, user interfaces, artwork, any computer applications, any and all copyrightable material (including source and object code), and all other materials, including without limitation the design, structure are protected by intellectual property laws (the "Intellectual Property laws"), including but not limited to copyright, trademark, trade dress, domain name, patent, trade secret, international treaties and other proprietary rights and unfair competition laws. You acknowledge and agree to abide by all relevant intellectual property laws as well as any special notices included on the Websites when using the BURQ FX Websites or the Content. All rights are reserved that are not specifically given.

Without the express prior written consent of BURQ FX, the BURQ FX Websites and the Content may not be copied, reproduced, modified, altered, translated, transmitted, displayed, published, posted, resold, or otherwise disseminated in any way. The content on this website may be viewed, printed, and downloaded by you as long as it is used only for personal, non-commercial, and educational purposes. On any reproductions of the Content you create, you must leave copyright and other markings intact. This website's open source content and papers are identified as such and available under the terms of the relevant open source licence. The specific applicable licence will regulate how you utilise such resources. Furthermore, BURQ FX makes no representations, warranties, or assurances as to the accuracy, timeliness, or suitability of any information or hosting services obtained via the Website, Online Mediums, and/or Content, nor that they will satisfy your needs and requirements or be free of viruses or other harmful components. You accept full responsibility for any loss or damage to your computer system, data, and company to the maximum extent authorised by law.

Liability Limitation

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BURQ FX SHALL NOT BE LIABLE FOR ANY DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • 1. Any direct, indirect, special, incidental, consequential, punitive, or exemplary damages resulting from your use of or in connection with the Websites, Online Mediums, or Content (including without limitation for loss of or damage to a business, revenues, goodwill, or data), even if BURQ FX and BURQ FX Licensors had been previously advised of, or reasonably could have foreseen, the possibility of such damages, however they arise, whether in violation of contract or otherwise
  • 2. Any loss or damage that you may incur, including without limitation as a result of any reliance placed by you on the accuracy, completeness, or suitability of the Content, or any changes that BURQ FX and BURQ FX Licensors may make to the Websites, Online Mediums, and Content
  • 3. Parts of the aforementioned limitation or exclusion may not apply to you because certain jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages.

Indemnity

You consent to hold harmless and indemnify BURQ FX, its subsidiaries, affiliates, shareholders, officers, directors, agents, employees and representatives, as well as BURQ FX Licensors, their subsidiaries, affiliates, shareholders, officers, directors, agents, employees and representatives, from and against any claims and demands, including reasonable attorneys' fees, made by any third party with respect to:

  • your use and access to the Websites, Online Mediums and Content;
  • the content that you submit, post, transmit or otherwise make available via the Website and Online Mediums;
  • any violation of these Terms or Website specific terms and conditions by You. This indemnification obligation will survive the termination of your BURQ FX account or these Terms.

Copyrights Infringement Complaints

You are not permitted to use the BURQ FX Websites, Content, or Online Mediums in any way that violates the legal rights of any third parties. The BURQ FX Websites encourage you to report any content that you think violates your copyright.

Trademarks

The trademarks, service marks, logos, slogans, and domain names (collectively, "Marks") mentioned on the BURQ FX Websites are either common-law service marks, trademarks, registered service marks, or trademarks of BURQ FX. or its subsidiaries and are protected by trademark laws in the UK, the EU, and other nations as well as by international laws and treaties. Reference to any other names of genuine businesses or goods on the BURQ FX Websites may be trademarks of the respective owners; however, this does not imply sponsorship, endorsement, or affiliation with BURQ FX. Nothing on the BURQ FX Websites should be interpreted as conferring any licence or permission to use any Marks displayed there, either implicitly or explicitly.

Without the prior written consent of BURQ FX or the third party that may own the Mark, you are not entitled to use any Marks displayed on the Websites, metatags, or any other "hidden text" utilising Marks of BURQ FX and its licensees.

Access to Mobile App and Online Web Portal

By using our mobile app and online web portal, you represent and warrant that you are 18 years or older. We have the right to cancel access if it comes to our attention that you are under the age of 18.

On completing the registration requirements on the mobile app or online web portal, you will be provided with login details that are not transferrable. You are responsible for ensuring that the mobile app and online web portal are only accessed by you and that log in details are kept safe and secure. Any damages as a result of the use of the login details by a third party will be your responsibility.

For any suspicions concerning the confidentially of the app and access to the online web portal, you must notify BURQ FX immediately. Any undue delay in contacting BURQ FX may result in you becoming liable for any losses.

Log in details must be updated regularly, every month as a minimum. Ensure that you log out of the app and online web portal after conducting the transaction. We reserve the right to disable access to the app or online web portal at any time for any reason including failure to abide by the terms and conditions.

For payments through the mobile app and the online web portal, you must ensure that you have funds in the account from which payment is being made. We accept payment by debit card but you must authorize your card issuer to transfer funds required to be received by us for the transaction. Please note that we do not provide service for the credit card user.

Terms and conditions of the card issuer will apply to the use of your card or bank account and you must refer to such agreements when making funds required for the transaction.

For conducting online transactions, you will need to obtain equipment including a computer or device, telecommunications lines, an operating system, printer to print out any records on paper. You acknowledge that certain software and equipment that you use may not be able to support certain features of our services. We have the right to discontinue supporting an operating system if we determine that the operating system is open to security risks.

Password and Security

You will be required to provide a password and a legitimate email address as Your username prior to placing your first money transfer transaction. Other than you, no one else is permitted to use the username or the password. You are accountable for the security of all transactions made using your username or password as well as your password. NEVER TELL ANYONE YOUR PASSWORD AND DON'T EVER WRITE IT DOWN! You agree to immediately alert Us by phone of any unauthorised use of your username, password, or other security breach.

We will immediately take all necessary steps to stop any further use of this information once You have let Us know about the unauthorised use of Your password or username. We are not responsible for any loss or harm that arises from Your failure to carry out Your obligation under this clause even though We have prompted you to take these actions. However, if your bank card or bank account were used fraudulently, you might be eligible for a specific amount of compensation or credit from your card issuer.

Transfer Fees

Prior to completing the money transfer transaction, the sender is shown information outlining how BURQ FX charges the sender for making the transfer on the BURQ FX website on https://burqfx.com/. The section contains information on the specific transfer fees for a money transfer transaction. Money transfer payments may occasionally be subject to back-end fees such as service fees and local taxes. Receiving funds from the Sender via a mobile phone, an account-based money transfer, or other means could result in additional fees for the Receiver.

The recipient institution (where the recipient has an account) may convert the funds at its own exchange rate or may even refuse the money transfer if it is not sent to the recipient's local currency account. The Receiver's contract with his or her mobile phone service provider, mobile wallet account provider, or other account provider administers the account and establishes their rights, obligations, relevant fees, the amount of monies that may be withdrawn from the account, and account restrictions. BURQ FX has the right to impose additional charges for using a particular account to send or receive money transfers. Regarding expenses that the Sender or any account holder may suffer in connection with the currency rate used for the conversion into non-local currencies or for acts, BURQ FX disclaims all responsibility.

Our Responsibility to You

1. We pledge Our willingness to offer You individual payments in line with these terms and conditions, along with the necessary information and money transfer services, and to take appropriate precautions.

2. We disclaim all responsibility for the following:

  • goods or services that You purchase through BURQ FX, including their delivery;
  • malfunctions in communication facilities over which We have no control;
  • data loss or transmission delays brought on by the use of an Internet service provider, a browser, or other software over which We have no control;
  • services offered by Your Card Issuer; v. viruses originating from third parties;
  • mistakes made by the BURQ FX Website or with the BURQ FX Online Service as a result of inaccurate or incomplete information supplied by You or a third party;
  • the unauthorised use of or access to data related to You or Your Transactions that We process, unless such use or access is the consequence of carelessness on Our part. iii. the unauthorised use of or interception of information prior to reaching the Website.

3. We are under no obligation towards You to initiate or execute a money transfer if:

  • We are unable to gather enough proof of Your identity;
  • You have provided Us with incorrect or incomplete information, or We have not received Your Transaction information promptly enough to ensure the prompt execution of the requested money transfer; iii. We have reason to believe that the Transaction information is incorrect, unauthorised, or forged;
  • The use of Your Bank Card to pay for the Transaction and Our fees is not permitted by Your Card Issuer.

4. We do not assume any liability for loss or damages caused to You or any third party from the non-payment or late payment of a money transfer to a Receiver or if the BURQ FX online service fails or declines to execute a Transaction by reason of any of these matters.

5. If your use is prohibited by BURQ FX regulations (such as those aimed at preventing fraud, money laundering, or financing terrorism), these Terms and Conditions, applicable law, a court order, or the requirements of a regulatory or government authority or any other body having jurisdiction over us, we have the right to refuse to provide you in whole or in part, cancel or suspend a Transaction, or, if applicable, both. Unless we are precluded from doing so, We shall tell You if We decline to provide the BURQ FX service to You (completely or partially) for legal reasons. It is a breach of these Terms and Conditions to use the BURQ FX services for any Prohibited Purpose.

6. We may, in our absolute discretion, impose limits on the Transaction amount, either on a per Transaction basis or on an aggregated basis.

7. If circumstances outside of our control force us to take this action and we deem it necessary ("Force Majeure"), we have the right to partially or completely stop operating the BURQ FX Website or the BURQ FX Online Service. If for any reason (whether caused by Us, a third-party provider, or in any other way) the services offered on the BURQ FX Website should be interrupted, We shall take reasonable steps to minimise the length of this interruption.

Your Responsibility Towards Us

1. You acknowledge and agree that You will pay Us Our fees (see also the section above on transfer fees) for each money transfer You start using the BURQ FX Service.

2. If BURQ FX allows an account-based money transfer, you must pay the basic amount of the transfer plus Our fees using a bank card or money from your bank account. You agree that Your card issuer will clear the basic amount of the money transfer plus Our fees for the specific Transaction, or that this amount will be transferred from Your bank account to Us before We carry out the transfer or any other Transaction. Prior to the final authorisation of the Transaction You will be notified of the precise amount which We will clear with Your Card Issuer or which We will debit from Your bank account.

3. You consent to and acknowledge the following:

  • The information provided in order to effect an online money transfer is true, accurate, current and complete;
  • You will provide Us with any identity, verification or further information or documents as may be requested by Us;
  • You must share the Transaction data (amount of money, Your name, Your country, name of Receiver and PIN) with the Receiver only. You are obligated to ensure that no third party can gain unauthorised access to this information. We recommend that You transfer money only to beneficiaries that You know personally;
  • You shall not provide false, inaccurate or misleading information;
  • You shall not use any anonymizing tool that attempts to make your activities untraceable;
  • You shall not use the BURQ FX Service for Prohibited Purposes;
  • Within the framework of the BURQ FX Service You will not initiate money transfers which violate these Terms and Conditions or any other restrictions of use or terms of use as set forth on the BURQ FX Website; and
  • You are personally responsible for keeping Your password and Your username safe.

4. You must contact us right once by phone if the Transaction data is lost, stolen, copied, or used inappropriately. If You Have Given Such Information To Any Person Other Than The Recipient Of The Money Payment Or If You Have Facilitated The Improper Use Of The Payment Instrument With Fraudulent Intent Or If You Have Violated Your Duty Of Care With Intentionally Or With Gross Negligence, You Will Be Liable To Us For Damages Resulting From The Improper Use Of The Transaction Data Until The Moment When BURQ FX Has Been Notified. If you participated to the misuse with the aim to deceive, you are no longer liable after receiving the notification from BURQ FX. You shall equally notify Us immediately upon learning of a money transfer which You did not authorize or which was executed erroneously.

5. You consent to and acknowledge that We may forward any particulars about You and the Receiver and about the services that We provided to You if necessary to regulatory or government authorities or their bodies if:

  • we are obligated by law to do so; or
  • we are of the opinion that such a disclosure may assist in the prevention of fraud, money laundering or other crimes.

6. It is your duty to check that all information is correct before submitting a Transaction request. A Transaction request's details cannot often be changed once it has been filed. Before submitting, you will have the chance to verify and confirm all Transaction details.
